Automated voice call logs generated through our Retell AI voice infrastructure are permanently purged after a maximum retention period of 90 days. WhatsApp messaging logs and CRM interaction records are purged after a maximum of 60 days. Beyond these windows, no copies of such logs are retained by the Agency.
5. Statutory Rights Under the DPDP Act
Data principals hold immutable statutory entitlements to access, correct, and request erasure of their personal data pursuant to the DPDP Act, 2023. 1. Acceptance of Terms
These Terms of Service govern the business relationship between Technical Waves LLP ("the Agency") and any client ("you", "the Client") engaging our AI automation infrastructure services. By engaging our services or submitting an inquiry, you agree to be bound by these terms.
2. System Licenses & Intellectual Property
The Agency grants Clients a non-exclusive, revocable license to operate custom-built Make.com automation scenarios and Retell AI voice agents on the Client's own business infrastructure for the duration of the active service agreement. Clients are strictly prohibited from copying, duplicating, reselling, or reverse-engineering the Agency's proprietary workflow design nodes, automation logic, or system architecture for external commercial purposes.
3. Financial Terms
Monthly retainers and one-time setup fees are invoiced on the 1st calendar day of every month. Accepted payment methods include Razorpay and Stripe (covering UPI and Credit/Debit Cards) as well as direct Bank Transfers (NEFT/RTGS). Payments remaining overdue beyond a 7-day grace window from the invoice date will trigger an automatic late fee accruing at 18% per annum on the outstanding balance.
4. Cancellation & No-Refund Policy
All payments made to Technical Waves LLP — including one-time setup fees and recurring monthly retainers — are strictly non-refundable, owing to the custom labor, configuration, and infrastructure provisioning involved in each engagement. Clients wishing to discontinue services must provide 30 days' written notice prior to their next billing cycle. No prorated refunds will be issued for partially used billing months under any circumstances.
5. Service Level Agreement & Liability Limitation
Technical Waves LLP targets completion of core automation architecture setups within 15 working days of project kickoff, subject to timely Client cooperation and data access. The Agency's financial liability arising from downtime, outages, or service interruptions caused by third-party API providers (including but not limited to Anthropic, OpenAI, Meta, and Make.com) is capped at zero, as such infrastructure falls outside the Agency's direct control.
6. Termination
Either party may terminate an active service agreement by providing 30 days' written notice to the other party. Upon termination, all active Make.com automation scenarios associated with the Client's account will be immediately deactivated.
7. Governing Law
These Terms of Service are governed by the laws of India, with exclusive jurisdiction vested in the courts of Ahmedabad, Gujarat.
